Terms of Service

1. Agreement to Terms

By accessing or using NEED a DAN services (operated by NETIUS), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

NEED a DAN provides web development services including but not limited to:

• Website recovery and rebuilds
• E-commerce integration (Shopify and custom solutions)
• WordPress to modern stack migrations
• Technical troubleshooting and maintenance

3. Project Scope and Changes

All projects begin with a clear scope agreement. Changes to project scope may result in adjusted timelines and costs. We will communicate any necessary changes promptly and seek approval before proceeding.

4. Payment Terms

Payment terms will be outlined in individual project proposals. Generally, projects require a deposit before work begins and final payment upon completion. Late payments may result in project delays or suspension of services.

5. Intellectual Property

Upon full payment, you will own the final deliverables created specifically for your project. We retain rights to pre-existing materials, frameworks, and code libraries used in development. We reserve the right to showcase completed work in our portfolio unless otherwise agreed.

6. Client Responsibilities

Clients are responsible for:

• Providing timely feedback and approvals
• Supplying necessary content, credentials, and assets
• Maintaining backups of existing systems
• Complying with third-party service terms (hosting, domains, etc.)

7. Warranties and Limitations

We provide services with professional care and skill. However, we do not guarantee that services will be uninterrupted or error-free. We are not liable for damages resulting from third-party services, hosting issues, or factors outside our control.

8. Termination

Either party may terminate a project with written notice. Upon termination, you will pay for work completed to date. We will provide deliverables for completed phases upon receipt of payment.

9. Confidentiality

We respect your confidentiality and will not disclose sensitive business information without permission. We may use non-sensitive project details for portfolio purposes.
